If you have served a Section 21 notice, and have then agreed for the tenants to remain in the property after the notice period has lapsed then you do not need to serve another notice as long as you have complied with the usual requirements for service of a S21 notice.
We advise making sure any extension is agreed in writing with the tenants. An exception to this may be if the Landlord does something to suggest that a new tenancy has begun however simply agreeing an extension of time with the tenants will not suggest this. If you do enter into a new tenancy with the tenants (including renewals) then you will need to send a new S21 notice.
You should also be aware that if the tenant refuses to leave after the expiry of a S21 notice then you will not be able to issue possession proceedings if more than 6 months have lapsed since the S21 notice was sent to the tenant.
Please note that S21 notices are no longer valid for tenancies in Wales
