If you have served a Section 21 notice to your tenants, but have agreed for them to remain in the property for a longer period since, you do not need to serve another notice as long as you have complied with the usual requirements for service of a S21 notice. We advise making sure any extension is agreed in writing with the tenants.
In Wales the original Section 21 notice will be valid indefinitely. An exception might be if the Landlord did something to suggest a new tenancy has started. However, simply allowing your tenants some more time to find a new property for example, would not suggest this. Please note that S21 notices cannot be used for tenancies starting in Wales on or after 15 July 2022. You can see more information here.
In England notice will only be valid for six months from the date on which the notice is given (Section 21(4D) HA 1988). New notice would need to be served after this point.
