During the fixed term
Rent review clauses are not included in standard occupation contracts. Landlords can only increase the rent within the fixed term if the tenant agrees to this.
Entering into a new fixed term Occupation contract
The rent can be increased if the tenants agree to enter into a new fixed term occupation contract.
During a periodic occupation contract
If the fixed term of the occupation contract has ended and the tenants have continued to occupy the premises under a periodic occupation contract then Landlords can vary the rent by giving 2 months notice using Form RHW12. The rent cannot then be increased further for 12 months afterwards.
