No, landlords with properties in Wales should continue to use current tenancy agreements for any tenancy signed before the 1st December (including renewals). This is irrespective of whether the tenancy start date is before or after the 1st December, the determining factor of the legislation is when the agreement is entered into (when it is signed).
On OpenRent, any Rent Now applications that have started, but where the contract hasn’t been signed, will be automatically reset on 1st December to provide you with our new standard occupation contract.
Landlords, including those using our Rent Now tenancy creation service, should continue using an Assured Shorthold Tenancy agreement (AST) until 1st December 2022. Landlords should be aware that contracts entered into before 1st December 2022, and that continue through, will become what are known as “converted occupation contracts”- to which the new legislation applies.
Why can't I use the new contract now?
The new type of contract, standard occupation contracts, won't be legally enforceable until the Renting Homes (Wales) Act 2016 comes into effect on 1st December 2022. If you sign a standard occupation contract before that point it will put you and the tenant(s) at risk.
